licensed in the State of Washington, and
_______________________ , a WA State licensed contractor
in good standing, hereby enter into this legally
enforceable contract agreement, whereas:
Process of the Referral Business Operation:
_______________________, as a business referral
service, receives inquiries (and bid requests) from
consumers who seek a labor and materials bid estimate
from a contractor(s) for woodworking projects they
intend to procure or have installed.
FencingBrokers.com and __________________________
encourages reputable licensed contractors to affiliate
(register) with our referral service to receive
referrals from our inquiring consumers.
Contractor Process. When a contractor
has registered and been accepted by your referral
business, _____________________
___________________________________, it is with the
understanding that the contractor, upon receipt of a
consumers estimated bid request, referred to them from
your referral business______________________________ via
email and/or phone, will, within 3 days maximum , make
contact with the consumer to schedule an appointment to
review the project requirements with them and to visit
the job site (if applicable).
Contractor, within 2 days of visiting the consumer, will
submit a bid estimate for labor and materials. If
the bid estimate is not replied to by the consumer to
the contractor within 5 days, contractor will follow-up
by phone or in-person to see if there are any questions
the consumer might have about the bid.
If/when bid is accepted, contractor will send an email
to to inform _______________________ of the accepted bid
estimate by the consumer, and cite the consumer name,
bid amount, when the job is to begin and when it is
expected to be completed.
A copy of the ACCEPTED BID PROPOSAL will immediately
be faxed by the contractor to ___________________ at
Phone # _______________________ or via email to referral
business, __________________________.
If bid has not been accepted, yet 10 days
have passed since contractor first made contact with the
consumer, contractor MUST NOTIFY the referral service of
the latest status at that time and your referral
business_____________ ______________________ will also
attempt to follow-up with the consumer for a response.
Referral Fee. For any referral to the
Contractor in which the contractor submits bid proposals
for, and it is accepted by the consumer, the contractor
agrees to pay your referral business
____________________________ a referral fee of 10% (or
$250 minimum whichever is greater) of the total amount
to be paid by the consumer. This fee is to be paid
to the order of your referral business,
_______________________ within a maximum of 6 days of
bid acceptance.
NOTE: It would behoove contractor to collect a
work deposit from the consumer at that time to cover
your cost for the referral fee. After 10
days of acceptance, if payment of the referral fee has
not been made to _______________________ by the
contractor, a late fee of $35 will be assessed, be due
and payable immediately. After 30 days past due,
contractor affiliation with _____________________ will
regrettably be terminated, and the unpaid amount will
incur a 1.5% per month interest charge based on the
accumulated unpaid balance.
Defaults. Failure to perform work
satisfactorily for the consumer does not relieve
contractor from the obligation to pay this referral fee
or any additional charges due thereafter in regard to
this referral account. Contractor accept
full responsibility for job performance, job completion,
and consumer satisfaction. Contractor holds
FencingBrokers.com and your referral business,
____________________ totally harmless from any
responsibility or liability related to the contractors
obligation to the consumer. Contractor fully
understands and agrees they will be responsible for any
financial liability incurred in any mediation/litigation
between the consumer and this referral requirement and
hold FencingBrokers.com and your referral business
___________________________ totally harmless from any
financial impact incurred. As such, contractor
will be totally responsible for immediate payment of any
legal fees, including attorney fees, court costs, etc,
should legal defense become necessary for
FencingBrokers.com.
Your referral business,__________________________,
holds FencingBrokers.com totally harmless from any
responsibility or liability related to either your
business or its operations, or the contractors
operations and their obligation to the consumer and the
buying public. You, as a business owner yourself,
fully understand and agree, you will be responsible for
any financial liability incurred in any
mediation/litigation between your business and that of
fencingbrokers.com, as well as between consumers and
contractors, if levied against us. |
